An internship agreement is not a special agreement within the meaning of Book 7 of the Dutch Civil Code and Book 7A of the Dutch Civil Code. Contrary to special agreements such as an assignment agreement, an agency contract, an employment contract, a settlement agreement, a construction contract, a rental agreement, etc., there is no statutory regulation applicable to an internship agreement.
Internship contract or employment contract?
An internship contract is legally not an employment contract. An internship does not involve 'work' as part of an employment contract. As a result, the legal provisions of the dismissal law do not apply to an intern. Nevertheless, an internship contract often resembles an employment contract because it contains the same elements. In order to prevent an internship contract from still being regarded as an employment contract, an internship contract must be carefully drawn up and its content must be in line with practice. Particular attention should be paid to the fact that the internship contract must clearly show that the work to be done by the intern is aimed at expanding his knowledge and experience and that the duration of the internship contract should not be too long. Furthermore, the internship ratio must not be too high. Other aspects may also be important.
