Internship contract: no employment contract
An internship agreement is not a special agreement as defined in Book 7 of the Dutch Civil Code (BW) and Book 7A of the Dutch Civil Code, such as an agency agreement, employment contract, settlement agreement or lease agreement. It is therefore also important not to regard an internship agreement as an employment contract. Although a traineeship agreement is sometimes very similar to an employment contract, in the case of an internship no work is done as part of an employment contract and the aim is to expand knowledge and gain experience in practice. This has an impact on whether or not the legal provisions of the law on termination of employment apply. In order to prevent an internship contract from still being regarded as an employment contract, one must be careful when drawing up such a contract. A legal expert can point out certain elements that you should pay extra attention to, or elements that should not be laid down in a traineeship agreement.
